Terms of Service

Effective October 16, 2026

The short version. Rose is a companionship service. She calls your mom for a friendly conversation and texts you a summary. She is not a doctor, a nurse, a caregiver, or an emergency service. Rose is free while we are getting started. If we ever add a paid plan, we will text you first, and nothing is charged unless you say yes. By calling Rose and giving us phone numbers, you agree to receive automated calls and texts from Rose.

1. The agreement

Rose is an independent project run by one person, not a company. These terms are an agreement between you and that person ("Rose", "we", "us"). They cover roseformom.com, the Rose phone number, and the calls, texts, and life-story book we provide (together, the "Service"). By calling Rose or otherwise using the Service you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.

You must be at least 18 years old to subscribe.

2. What Rose is, and is not

Rose is companionship. Rose is an AI companion who has friendly, unhurried phone conversations with the person you designate (the "participant"), and sends you a written summary afterwards.

Rose is not medical advice. Rose is not a doctor, nurse, therapist, or licensed professional of any kind, and nothing Rose says or writes is medical, mental-health, legal, or financial advice. Summaries are Rose's impressions of a conversation. They may be incomplete or mistaken. Do not rely on them in place of your own judgment, a visit, or a professional's opinion.

Rose is not an emergency service. Rose cannot call 911, dispatch help, or respond to an emergency. If the participant says she needs help right away, Rose will tell her to hang up and call 911. If you are worried about the participant's safety, contact emergency services or someone who can physically reach her. Do not wait for a summary.

Rose is not a monitoring or care service. Rose does not guarantee that every concern will be noticed or flagged, that every call will connect, or that a missed call means anything in particular. Rose is one warm voice in the participant's day, not a substitute for family, neighbors, or professional care.

3. Your account and the participant

4. Consent to automated calls and texts

By calling Rose, or by signing up for texts on roseformom.com, and providing phone numbers you expressly consent, on your own behalf and on behalf of the participant where you have the right to do so, to receive calls and text messages from Rose at those numbers. These calls and texts are placed using automated technology and an artificial or pre-recorded voice. Specifically:

Calls may be recorded and are transcribed so that Rose can write summaries and remember earlier conversations. Rose tells the participant this on the first call. You are responsible for ensuring that the participant is aware calls are kept, as described in our Privacy Policy.

5. Price, paid plans, and cancellation

6. Acceptable use

Don't use Rose to call someone who hasn't agreed to be called, to harass anyone, to collect information about a person without their knowledge, or for anything unlawful. Don't try to interfere with, reverse engineer, or overload the Service. We may suspend or end an account that breaks these rules.

7. The life-story book

The stories the participant tells belong to the participant and her family. Rose's written arrangement of them is licensed to you for personal, family use. You may share and reproduce the book however your family likes. We don't claim any right to publish it or to use it beyond providing the Service.

8. Our content

The Rose name, website, voice, and software are ours or our licensors'. You may use the Service for your personal, non-commercial use and not otherwise.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that calls will always connect, that summaries will be complete or accurate, or that the Service will be uninterrupted or error-free. AI systems make mistakes, and Rose will too.

10. Limitation of liability

To the fullest extent the law allows, Rose will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on a summary, a missed or failed call, or something Rose said or did not say. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose. Some jurisdictions don't allow these limits, in which case they apply to the extent permitted.

11. Changes to the Service or these terms

We may change the Service, and we may update these terms. If a change is material we'll text subscribers before it takes effect. Continuing to use the Service after that means you accept the change. If you don't, cancel and you won't be charged again.

12. Governing law and disputes

These terms are governed by the laws of the U.S. state where Rose's operator lives, without regard to its conflict-of-law rules. If we have a dispute, let's talk first: email dankwun@gmail.com and we'll try to work it out. Any dispute we can't resolve will be brought in the state or federal courts of that state, and you and we consent to their jurisdiction.
